RE: DELINKING OF 33 YRS OF QUALIFYING SERVICE FOR LIC PENSIONERS

Respected RK Sahni Sir and office bearers of AIIREF,
                                                                                          I am a class 3 LIC pensioner who retired in February 2015 with only 19 years of service  from May 1996 to February 2015 with the corporation thanks to my previous central govt. service in Defence forces for a period of 21 years from Nov 1973 to Nov 1994.
                            For your information and further action I am submitting few matters below.I feel that such an issue has never come up till such time.
                              First of all I wish all success for our old pensioners for their pension up dation fight against LIC in Delhi High court and the Hon'ble  Supreme Court as well.Noted the recent developments in DHC which culminated in ending of arguments and bench reserving the judgement pending written submission by both parties within 10 days. From the arguments it seems that the judgement is going to come in our favour.At this crucial juncture ,our category of LIC pensioners (both officers and employees) thus request your good self to include this particular issue of delinking 33 years of service for LIC PENSIONERS vide our senior counsels while submitting the written submissions to the DHC as this is going to benefit many pensioners (including officers and employees) with less than 33 years of service having only pro rata pension.
                              Sir, as you all aware of the fact that due to the various verdicts of Delhi High court,Kerala High Court ,Punjab and Haryana High court and the Central Administrative Tribunal Kochi Bench all Pre-2006 central govt pensioners including ex -servicemen  have been awarded 50%pension delinking 33 years of qualifying service I.e. W/o Pro rata irrespective of minimum qualifying service (10 yrs for LIC EMPLOYEES)vide GOI
Min.of Personnel PG & Pension -Dept.of Pension and Pension Welfare -OM NO.38/37/08-P&PW (A) dated 06 April 2016,same ministry's previous letter dated 02 September 2008 and GOI ,Min. Of Fin.  Dept.of Expenditure CPAO NEW DELHI OM no.cpao/it &tech/REVISION (PRE-2006)2016-2017/8 8 vol-vi/58 dated 13 th June 2016 as per the 6th CPC. The orders for payment of arrears for all pre 2006 pensioners have been promulgated and by this time almost all have received the arrears.
                            Sir,at this juncture I would like to bring to your kind attention that when all central govt. pensioners have been delinked with 33 years of QS why not we ex servicemen LIC Pensioners  and all those who have got very less service below 33 years in LIC be also delinked with 33 years of QS and be paid 50% of average of last 10 months salary as pension without pro rata.

                              I hope that as the  Central Govt.itself has cleared the matter after the SLP(C) petitions filed by them in Hon.Supreme Court have been dismissed and the verdict for 50% pension with pro rata pension by the various courts  have been upheld,our LIC pensioners with less than 33 yrs of QS should also be paid 50% pension without pro rata as rule 56 of LIC pension rule of 1995 which has got nexus with CCS(P) RULE of 1972.As such the rule linking of 33 years of QS for all those pensioners with less than 33 years of service should be totally dispensed with.Moreover from 2013 onwards the RBI pensioners are also receiving the similar benefit from vide their cir no.8 of 18 March 2013 and their letter no.CO HRMD NO.G.102/5998/21.01/2012-2013 dated 18 March 2013.   

                                Sir, if this is done it will benefit almost all the LIC pensioners who rendered less than 33 years of QS (Officers and employees)especially Ex-servicemen pensioners who have strived hard for the security,safety and integrity of our motherland ,India by serving in the armed forces.
                            Sir I have informed the same issue to office bearers of AIIPA also and request you also to take up the same.     
                                    I am awaiting for your reply  and also for the action to be initiated by AIIREF for the benefit of all LIC pensioners with less than 33 years of qualifying service.By the way I am ready to make you available any data whatsoever available with me which will help you to solve this particular issue.
